  • Property Owner or Agent: Refers to any individual, business, or authorized representative listing properties for sale, rent, or lease on the Platform.
  • Service: Refers to the Website and its associated features, tools, and functionalities.
  • Terms and Conditions (Terms): Refer to these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
  • Third-party Social Media Service: Refers to any services or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available by the Service.
  • User: Refers to any individual accessing or using the Platform, including property seekers, property owners, agents, or casual visitors.
  • Website: Refers to the Keja Yangu website, accessible from https://kejayangu.com.
  • You: Refers to the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

3. User Eligibility

To use the Keja Yangu Platform, You must meet the following eligibility requirements:

  • Age Restrictions: You must be at least 18 years old to create an account or use our Services. By accessing or using the Platform, You acknowledge that You meet this age requirement and are legally able to enter into a binding agreement.
  • Property Listings: Only property owners, authorized agencies, agents, and Managers/Caretakers are permitted to list properties on the Platform. By listing a property, You acknowledge that You have the legal right to do so and that the information provided is accurate, truthful, and complies with applicable laws.
  • Legal Compliance: All Users, including property owners, agents, and seekers, must comply with applicable Kenyan laws and local property regulations when using the Platform. You acknowledge and agree to abide by these regulations, and that failure to do so may result in the suspension or termination of Your access to the Platform. Keja Yangu reserves the right to restrict or terminate access for any violations of these Terms or relevant laws.

By accessing or using the Keja Yangu Platform, You acknowledge that Your use is subject to these eligibility requirements, and You agree to comply with the Terms and Conditions governing this Service.


4. Account Registration and Usage

To access certain features of the Keja Yangu Platform, Users are required to create an account. The following conditions apply:

Account Creation

  • To create an account, You must provide accurate, complete, and up-to-date information during the registration process. This includes, but is not limited to, Your full name, contact details, and any other required details. By registering, You acknowledge that all the information You provide is truthful, and You agree to keep Your account information current.

Security of Login Credentials

  • If You suspect unauthorized access to Your account, You agree to notify Keja Yangu immediately to prevent further issues.

User Responsibility

  • You are solely responsible for all activities and interactions conducted through Your account. This includes any messages, listings, or other engagements on the Platform. You acknowledge that Keja Yangu is not responsible for the actions or conduct of Users within the Platform.
  • Keja Yangu shall not be held liable for any unauthorized access or misuse of Your account due to Your failure to secure Your login credentials.

By continuing to use the Platform, You acknowledge and agree to all terms outlined in this section, and accept the Terms and Conditions that govern Your use of this Service.

The following services are available to all users of the platform:

Keja Yangu allows users to search for properties based on their preferences and requirements. Whether you are looking for a house, apartment, office space, or land, our user-friendly search tools enable you to filter listings by location, price, property type, and other relevant criteria. The property listings are regularly updated to ensure you have access to the most current options available.

  • Search Options: Users can browse properties for sale or rent in cities such as Nairobi, Mombasa, Kisumu, Eldoret, Meru, Thika, and any other towns in Kenya.
  • Detailed Listings: Each listing includes comprehensive details such as property features, photos, pricing, and location.

Listing of Properties by Owners, Agencies, Agents, and Managers/Caretakers

Keja Yangu provides property owners, authorized agencies, agents, and managers/caretakers with a streamlined process to list and manage properties on the platform. Whether you are an individual property owner, a real estate agency, or a caretaker managing properties, you can easily create an account to upload and manage your property listings. This includes adding detailed descriptions, high-quality images, setting prices, and updating property details in real-time.

Property Listings

  • Eligibility to List Properties: Property owners, authorized agencies, agents, and managers/caretakers are all eligible to list residential, commercial, and land properties on the platform.
  • Types of Properties: Listings can include a variety of properties such as:
    • Residential Properties: Houses, apartments, villas, townhouses, etc.
    • Commercial Properties: Office spaces, retail spaces, warehouses, etc.
    • Land: Residential and commercial land for sale or lease.
  • Easy Listing Management: Users can manage their listings with ease. You can:
    • Add or Remove Listings: Post new properties and remove outdated or unavailable listings.
    • Edit Property Details: Update property information such as descriptions, location, amenities, and specifications.
    • Add High-Quality Images: Upload photos of properties that best showcase their features.
    • Set and Update Prices: Adjust pricing for rent, sale, or lease based on market conditions.

Agent Access

  • Managing Multiple Listings: Authorized real estate agents can manage multiple property listings on behalf of their clients. Agents can list properties for sale, rent, or lease, representing property owners or landlords.
  • Efficient Property Management: Agents can easily add, edit, and update property details, including uploading images, setting prices, and adding important information that potential buyers or renters may need. Agents will have access to their own dashboard to track, update, and manage all the listings under their portfolio.
  • Agency and Manager Access:
    • Agencies: Real estate agencies can list properties on behalf of their clients, providing a centralized platform for clients to view available properties.
    • Managers/Caretakers: Managers or caretakers who oversee the maintenance and rental of properties can list those properties, ensuring that tenants or buyers have the most current and accurate information.

Notifications and Updates for Property Seekers

Keja Yangu ensures that property seekers never miss an opportunity by providing notifications and updates. Users can opt to receive alerts for new listings, changes in pricing, or when properties match their search criteria.

  • Personalized Alerts: Users can set up custom alerts based on specific property requirements (e.g., location, budget, type).
  • Instant Updates: Subscribers to alerts will receive real-time updates whenever a new listing or change occurs.

Role of Keja Yangu

While Keja Yangu provides an extensive platform for property seekers and owners to interact, it is important to note that Keja Yangu does not directly sell, rent, or manage properties. We act solely as a facilitator, connecting users with property owners and agents. Keja Yangu does not have ownership of, or direct involvement in the transactions related to properties listed on the platform.

  • Facilitator Role: Keja Yangu’s primary function is to provide the technology and platform for users to find and list properties. We do not take part in the actual property transaction process, such as negotiating prices, finalizing deals, or managing payments.
  • Third-Party Transactions: All property transactions (buying, renting, or leasing) are conducted directly between property owners, agents, and users.

By using the services provided by Keja Yangu, you acknowledge and agree that we are not responsible for the accuracy of the property listings, nor do we guarantee the successful completion of any transactions between users.


6. Listing Properties

Keja Yangu allows property owners, authorized agencies, agents, and managers/caretakers to list properties for sale, rent, or lease on the platform. This section outlines the guidelines that property owners, authorized agencies, agents, and managers/caretakers must adhere to when creating property listings. It is essential to maintain the integrity of the platform by providing accurate and honest information, ensuring compliance with Kenyan laws, and protecting the interests of all users.

Guidelines for Property Owners, authorized Agencies, Agents, and Managers/Caretakers

  1. Accuracy of Property Descriptions and Images
    Property owners and agents are responsible for ensuring that all descriptions, images, and details provided in property listings are accurate, truthful, and up to date. The information presented should give a clear and honest representation of the property, including its location, size, condition, features, and any other relevant details.
    • Property Descriptions: Descriptions must accurately reflect the property’s attributes, including the number of rooms, amenities, and condition. Avoid exaggerating or providing misleading information.
    • Images: All images uploaded should be current and accurately represent the property. Misleading or altered images (e.g., edited to enhance features or misrepresent the property’s condition) are strictly prohibited.
    • Disclosure of Issues: Property owners and agents must disclose any known issues with the property that could affect the buyer or renter’s decision, such as structural issues or legal disputes.
  2. Adherence to Kenyan Laws and Real Estate Regulations
    All property listings must comply with Kenyan real estate laws, local zoning regulations, and any applicable property rights or restrictions. Property owners, authorized agencies, agents, and managers/caretakers are responsible for ensuring that the property being listed is legally available for sale, rent, or lease under Kenyan law.
    • Ownership Verification: Property owners must verify that they have legal ownership of the property they wish to list. Agencies, agents, and managers/caretakers must have authorization from the property owner to list the property on their behalf.
    • Compliance with Local Regulations: All listings should be in line with relevant real estate regulations, including but not limited to tenancy laws, taxes, and property rights.
  3. Consequences for False or Misleading Information
    Providing false or misleading information in property listings can cause significant harm to both buyers and renters. Keja Yangu takes such violations seriously and will take appropriate action to protect users of the platform.
    • Removal of Listings: If Keja Yangu determines that a listing contains false or misleading information, we reserve the right to remove the listing without prior notice.
    • Account Suspension: Property owners, authorized agencies, agents, or managers/caretakers found repeatedly violating the guidelines may have their accounts suspended or permanently banned from the platform.
    • Legal Action: In cases of intentional fraud or misrepresentation, Keja Yangu reserves the right to take legal action in accordance with Kenyan law.

Verification of Ownership or Authority to List Properties

To maintain the integrity of the platform, property owners, authorized agencies, agents, and managers/caretakers must provide proof of ownership or valid authorization to list the property. Property owners must ensure that they have the right to sell, rent, or lease the property, and authorized agencies, agents, and managers/caretakers must have written consent from the property owner to list on their behalf.

  • Proof of Ownership: Property owners may be required to submit official documents (e.g., title deed, lease agreement) to verify ownership.
  • Agencies, Agents, and Managers/Caretakers Authorization: Authorized agencies, agents, and managers/caretakers must submit a letter of authorization or contract from the property owner that grants them the right to list the property on the platform.

Keja Yangu’s Right to Remove Listings

Keja Yangu reserves the right to remove any property listing that does not adhere to these guidelines, including but not limited to listings that contain false information, violate Kenyan real estate laws, or do not meet the platform’s standards. This ensures that all properties listed on the platform meet the highest standards of accuracy and compliance.

  • Non-Compliance Removal: Listings found to be in violation of these guidelines will be removed and the property owner, authorized agencies, agents, or managers/caretakers may be notified to correct the issue. If the violation is not resolved, the listing may be permanently removed from the platform.
  • Unlawful Listings: Any property that is listed in violation of the law or that cannot be legally sold, rented, or leased will be removed immediately.

By listing a property on Keja Yangu, property owners, and authorized agencies, agents, and managers/caretakers acknowledge and agree to adhere to these guidelines and accept responsibility for the accuracy and legality of the information provided.


7. Payments and Fees

Keja Yangu operates on a transparent payment system to ensure users have a seamless experience when listing properties, accessing premium services, or making one-time purchases. Below, we outline the fees and payment processes applicable to our platform:

Listing Fees

  • Property Listing Fees: Keja Yangu may charge property owners, agencies, agents, or managers/caretakers a fee for listing properties on the platform. The amount of the listing fee may vary depending on the type of property (residential, commercial, or land) and the level of visibility or premium features selected.
  • Subscription Plans: For users who require enhanced services, such as priority listing placement, additional visibility, or access to exclusive tools, Keja Yangu offers subscription plans that provide extended benefits beyond standard listings. Subscription fees are charged periodically, as indicated in the plan details.

One-Time Purchases

  • Payments for Goods, Items, or Services: Users can make one-time payments for specific goods, items, or services on the platform, such as purchasing property documents, reports, or other associated services.
  • Payment Confirmation: Once a payment is made, it is considered final and binding, unless otherwise stated in our refund policy.

Refund and Cancellation Policy

  • Listing Cancellations: Property listings that have been paid for can be canceled or removed by the user, but listing fees are generally non-refundable once the listing has been posted. Any exception to this will be governed by the specific refund policy outlined at the time of payment.
  • Subscription Cancellation: Subscription payments for premium services may be canceled before the next renewal date. However, payments for the current subscription period are non-refundable, unless otherwise stated.
  • Refund Eligibility: Refunds will only be issued if explicitly specified in the payment or service agreement, such as for services not delivered or errors in processing the payment. Accepted Payment Methods

Finality of Payments

  • All payments made through the platform are final and non-refundable, unless otherwise specified in this agreement or in a specific service’s refund policy. Users are advised to ensure that all details are correct before submitting payment.
  • Refunds, when applicable, will be processed as per the guidelines outlined in our refund policy.

8. User Conduct and Obligations

As a user of Keja Yangu, you agree to adhere to the platform’s ethical standards and uphold a respectful, safe, and trustworthy environment. All users must behave in a manner that aligns with the community guidelines and local laws.

User Responsibilities and Ethical Conduct

  • Respect and Integrity: Users must engage with the platform honestly and ethically, treating other users with respect and fairness. This includes not engaging in any form of harassment, hate speech, or discriminatory behavior based on race, religion, gender, sexual orientation, nationality, or other personal attributes.
  • Prohibited Activities:
    • Fraudulent or Misleading Listings: Users are strictly prohibited from posting fraudulent, misleading, or false property listings. This includes providing inaccurate property descriptions, altering images, or misrepresenting the availability, ownership, or condition of a property.
    • Harassment or Abusive Behavior: Harassment, bullying, or any abusive behavior targeting other users, property owners, agents, or staff is strictly forbidden. This includes verbal abuse, threats, or intimidation in any form.
    • Unauthorized Access or Misuse: Users must not attempt to hack, disrupt, or misuse the platform in any way, including gaining unauthorized access to accounts, modifying the site’s content, or attempting to alter its functionality.

Compliance with Kenyan Laws

Users are also expected to comply with all applicable Kenyan laws and regulations, including those governing real estate transactions, consumer protection, and digital conduct. Any activity that violates these laws will be subject to investigation and possible legal action.

Keja Yangu reserves the right to suspend or terminate the accounts of users who engage in inappropriate or illegal behavior. Continuous violations may result in permanent banning from the platform.

While Keja Yangu strives to provide a platform with accurate and up-to-date property listings, it is important to note that:

  • Keja Yangu encourages users to independently verify property details before making any purchasing, renting, or leasing decisions. This includes visiting the property, reviewing its legal status, and confirming any claims made in the property listings.
  • Keja Yangu does not guarantee the accuracy, completeness, or legality of property listings posted by third-party users, including property owners, agents, agencies, or managers/caretakers. While we provide a platform for users to share listings, the responsibility for the accuracy of such listings lies with the person or entity posting the information.
  • Limitation of Liability: Keja Yangu is not responsible for any discrepancies, issues, or losses arising from inaccurate or misleading listings, and users are encouraged to exercise due diligence when considering any property listed on the platform.

By using the platform, you acknowledge that Keja Yangu is a facilitator for property listings and does not directly verify the content posted by users. It remains your responsibility to ensure the authenticity of the information before proceeding with any property-related transaction.


10. Intellectual Property

Keja Yangu holds exclusive ownership rights to all content, branding, and platform features available on the website and mobile app. This includes, but is not limited to, text, graphics, logos, images, videos, software, website design, and other proprietary materials (collectively referred to as “Content”).

Ownership and Use of Content

  • Intellectual Property Rights: All Content on Keja Yangu is protected by intellectual property laws, including copyright, trademark, and patent laws. Users are prohibited from copying, reproducing, modifying, distributing, or using any of the Content without the express written consent of Keja Yangu.
  • User-Generated Content: When users upload content, such as property listings, images, descriptions, and other materials, they grant Keja Yangu a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content for promotional, marketing, and other legitimate business purposes. By uploading content to Keja Yangu, users affirm that they have the necessary rights and permissions to do so and that they will not infringe on the intellectual property rights of others.


11. Limitation of Liability

Keja Yangu serves as a facilitator by providing a platform for property owners, agents, and users to connect and interact. However, as a facilitator, Keja Yangu is not directly involved in property transactions and disclaims any responsibility for:

Exclusion of Liability

  • Accuracy or Legality of Listings: Keja Yangu does not guarantee the accuracy, completeness, or legality of property listings posted by users. The responsibility for ensuring the correctness and legality of listings rests with the property owner, agent, or agency that posts the listing.
  • Transactions or Agreements Between Users and Property Owners: Keja Yangu is not a party to any transaction or agreement between users and property owners. We do not verify the terms or conditions of such transactions and are not liable for any disputes, issues, or damages arising from such agreements.
  • Losses or Damages: Keja Yangu is not responsible for any financial losses, damages, or inconveniences incurred as a result of using the platform, including but not limited to losses related to inaccurate listings, failed transactions, or property-related issues.

Platform Availability and Technical Issues

  • No Guarantee of Platform Availability: Keja Yangu does not guarantee uninterrupted access to the platform, and the availability of the website or app may be affected by technical issues, maintenance, or unforeseen circumstances.
  • No Liability for Technical Problems: Keja Yangu is not liable for any downtime, server outages, or technical issues that may affect the functionality or availability of the platform. Users should be aware that access to the platform may be temporarily unavailable at times due to system updates or other technical factors.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Keja Yangu, on its own behalf and on behalf of its Affiliates, licensors, and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and warranties that may arise out of course of dealing, course of performance, usage, or trade practice.

Without limitation to the foregoing, Keja Yangu provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible with or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards, or be error-free. Keja Yangu does not guarantee that any errors or defects can or will be corrected.

Without limiting the foregoing, neither Keja Yangu nor any of its providers makes any representation or warranty of any kind, express or implied:

(i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon;

(ii) that the Service will be uninterrupted or error-free;

(iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or

(iv) that the Service, its servers, the content, or emails sent from or on behalf of Keja Yangu are free of viruses, scripts, trojan horses, worms, malware, timebombs, or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. However, in such a case, the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of Keja Yangu and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven’t purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall Keja Yangu or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if Keja Yangu or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these jurisdictions, each party’s liability will be limited to the greatest extent permitted by law.

  5. Failure to Pay Fees: If a user fails to make necessary payments for services (e.g., listing fees, subscriptions) as required by the platform.
  6. Abusive or Harmful Behavior: If a user engages in abusive, discriminatory, or harmful conduct towards other users, Keja Yangu staff, or the platform in general.

Keja Yangu will make reasonable efforts to notify users of any suspension or termination, but in cases of serious violations, action may be taken immediately.

Termination by User:

Users have the right to terminate their account at any time. If you wish to close your account, please contact Keja Yangu’s support team through the contact information provided on the platform. Upon termination, your access to the platform will be revoked, and your data will be handled in accordance with the Privacy Policy.

Effect of Termination:

Upon suspension or termination of your account:

  • You will lose access to the platform and all associated services.
  • Any data associated with your account (such as listings, personal details, or payment history) may be deleted or rendered inaccessible, in accordance with our Privacy Policy.
  • Any outstanding payments or fees will still be owed, and Keja Yangu reserves the right to pursue any legal action to recover these amounts.

Keja Yangu may, at its sole discretion, reinstate a suspended or terminated account after a review of the circumstances and the user’s commitment to complying with the platform’s terms and guidelines.


14. Dispute Resolution

Keja Yangu is committed to resolving disputes efficiently and amicably. In the event of any disagreements or issues related to the use of the platform, the following process will be followed:

Mediation and Amicable Resolution:

  • We encourage users to initially try to resolve any disputes informally by contacting Keja Yangu’s customer support. This step aims to promote direct communication and the amicable resolution of issues before escalating to formal processes.

Arbitration:

  • If informal mediation is unsuccessful, the dispute will be referred to binding arbitration, as outlined in the original terms. Arbitration will be conducted in Nairobi, Kenya, and will be governed by the Arbitration Act of Kenya. The decision of the arbitrator will be final and binding.

Jurisdiction and Governing Law:

  • The governing law for this agreement is the law of Kenya, excluding its conflicts of law rules. However, users outside Kenya may also be subject to local, state, national, or international laws applicable in their jurisdiction.
  • If you are located in the European Union (EU), you will benefit from any mandatory provisions of the law of the country where you reside.
  • U.S. Legal Compliance: By using the Service, you represent and warrant that you are not located in a country subject to a U.S. government embargo or listed as a “terrorist-supporting” country, and that you are not on any U.S. government restricted parties list.

Severability and Waiver:
